On 23 February 2017, the International Tennis Federation (ITF)’s decision not to grant an eligibility exemption to Mr Bedene pursuant to Regulation 35 of the Davis Cup Regulations was challenged by both Mr Bedene and the Lawn Tennis Association (LTA) by way of arbitration.

The matter was referred to Sport Resolutions and was determined by Mr Charles Hollander QC sitting as a sole arbitrator.

The arbitration considered the lawfulness of the ITF’s decision, with particular reference to Mr Bedene’s rights under Article 49 of the Treaty of the Functioning of the European Union (TFEU).
