Spending limits in sport: purpose, enforcement and legal realities
Many sports and leagues around the world have some form of salary cap or cost control mechanism in place to determine how much money can be spent on players, talent and technology. This could be in the form of a global squad limit or a percentage of turnover over a period of time.
What is the point of having arbitrary limits and what does it aim to achieve?
How are the rules enforced, and by what means can you capture those who need to be bound by the relevant rules? How is it possible to gain access to information and evidence, such as data on email and phones, to assist with an investigation?
In this session we will look at various models in place around the world and explore the challenges, both practical and legal, of having a system that limits the amount that can be spent on players, talent and research; including issues of enforceability and the operation and management of such systems by different sports and leagues.
