What is the difference between an investigation and a review?

Generally speaking, an investigation is a fact finding exercise as to whether there is evidence to support allegation(s), and that in light of the evidence gathered, it is more likely that the conduct took place, or not.

On the other hand, a review often deals with historical allegations, and whether or not those individual(s) or organisation(s) to whom those allegations were made properly investigated and took action at the time they were raised.

When should a international federation commission an independent investigation?

An independent investigation is often appropriate where allegations are serious, sensitive, contested, or carry legal, regulatory, or reputational risk. It may also be necessary where there is a real or perceived conflict of interest, or where internal handling could undermine confidence in the process or outcome.

Who conducts the investigation?

Investigations are led by suitably experienced and independent individuals appointed from Sport Resolutions’ panel. Panel members are selected based on the nature of the issues involved, their expertise, and their experience within the sport sector and related legal or regulatory frameworks.

How independent is the investigation from the commissioning organisation?

The appointed investigator acts independently of the commissioning organisation. Sport Resolutions ensures that appropriate checks are carried out to identify and manage conflicts of interest and that the investigation is conducted in accordance with agreed Terms of Reference, without influence over findings or conclusions.

What is the role of Sport Resolutions during an investigation?

Sport Resolutions provides independent administrative and secretariat support to the investigation. This may include managing communications, arranging interviews, collating documentation, and supporting procedural efficiency, while the investigator retains full responsibility for the conduct of the investigation and any findings or recommendations.

What happens at the start of an investigation?

At the outset, Terms of Reference are agreed, setting out the scope, parameters, and contractual arrangements. An investigation plan may also be developed, outlining the proposed approach, key stages, and reporting arrangements.

Will individuals involved be given an opportunity to respond?

Yes. Investigations are conducted in accordance with principles of fairness and procedural rigour. Individuals who are the subject of allegations or whose conduct is under consideration are ordinarily given an opportunity to respond to relevant matters within the scope of the investigation.

How are confidentiality and data protection managed?

Confidentiality is managed carefully throughout the investigation, subject to legal and regulatory obligations. Data protection requirements are observed, and information is handled securely, with access limited to those who need it for the purposes of the investigation.

What is the outcome of an investigation?

The outcome is typically a written report setting out the investigator’s findings and, where appropriate, recommendations. The investigator does not make disciplinary decisions or impose sanctions; responsibility for next steps usually rests with the commissioning organisation.

How long does an investigation typically take?

Timescales depend on the scope and complexity of the issues, the number of witnesses involved, and the availability of information.
